Welcome to Ripple Habit Tracker ("Ripple," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our mobile application and related services (collectively, the "Service").

By downloading, installing, or using Ripple, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Description of Service

1.1 Core Functionality

Ripple is a habit tracking mobile application that helps users:

  • Create and manage daily habits
  • Track habit completion and build streaks
  • Monitor progress through calendar views and analytics
  • Receive timezone-aware reminder notifications
  • Earn XP points and achievements for motivation
  • Access insights and performance statistics

1.2 Service Availability

We provide Ripple on a "freemium" basis with:

  • Free Tier: Access to core habit tracking (1 habit maximum)
  • Premium Subscription: Full access to unlimited habits and advanced features
  • 7-Day Free Trial: Full premium access for new users

1.3 Technical Requirements

To use Ripple, you need:

  • Compatible iOS device (iPhone/iPad)
  • iOS 12.0 or later
  • Internet connection for data synchronization
  • Valid Apple ID for App Store access

2. User Accounts

2.1 Account Creation

To use Ripple, you must:

  • Create an account with a valid email address
  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Be at least 13 years of age (or minimum age in your jurisdiction)

2.2 Account Responsibility

You are responsible for:

  • All activities that occur under your account
  • Maintaining the security of your login credentials
  • Notifying us immediately of any unauthorized use
  • Providing accurate and up-to-date account information

2.3 Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service
  • You provide false or misleading information
  • Your account remains inactive for an extended period
  • We discontinue the Service (with reasonable notice)

3. Subscription Terms

3.1 Free Trial

7-Day Free Trial for New Users:

  • Automatically granted upon account creation
  • Full access to all premium features during trial
  • No payment required during trial period
  • Automatic conversion to free tier if no subscription purchased
  • Clear trial status displayed in the app

3.2 Premium Subscription Options

Monthly Subscription: $3.99/month

  • Up to 10 habit tracking
  • Advanced notification features
  • All gamification elements (XP, achievements, levels)
  • Priority customer support
  • Future premium features as released

Annual Subscription: $39.99/year

  • Same benefits as monthly subscription
  • 17% savings compared to monthly billing
  • Billed annually in advance

3.3 Subscription Management

Billing and Renewals:

  • All subscriptions managed through Apple App Store
  • Automatic renewal unless canceled at least 24 hours before expiration
  • Charges processed through your Apple ID payment method
  • Price changes effective at next renewal period with 30-day notice

Cancellation:

  • Cancel anytime through App Store subscription settings
  • Access to premium features continues until expiration
  • No refunds for unused subscription periods (per Apple policy)
  • Downgrade to free tier upon subscription expiration

3.4 Free Tier Limitations

After trial expiration or subscription cancellation:

  • Maximum 1 active habit allowed
  • Basic dashboard access only
  • Limited to 1 daily reminder notification
  • No access to advanced analytics or achievements
  • Standard customer support

4. Acceptable Use Policy

4.1 Permitted Uses

You may use Ripple to:

  • Track personal habits and goals
  • Monitor your progress and achievements
  • Receive motivational notifications and reminders
  • Export your personal habit data
  • Provide feedback and suggestions for improvement

4.2 Prohibited Uses

You may NOT:

  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Attempt to reverse engineer or modify the app
  • Upload malicious content or code
  • Interfere with Service operation or security
  • Create multiple accounts to circumvent limitations
  • Use automated tools to access the Service
  • Attempt to gain unauthorized access to our systems

4.3 Content Guidelines

When creating habits and personal content:

  • Keep content appropriate and legal
  • Do not include personal information of others
  • Respect intellectual property rights
  • Avoid harmful, offensive, or discriminatory content

5. Intellectual Property Rights

5.1 Our Intellectual Property

Ripple and all related content, including:

  • Software code, algorithms, and architecture
  • User interface design and graphics
  • Logos, trademarks, and brand elements
  • Documentation and help content
  • Audio, visual, and multimedia elements

Are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of your personal habit data and content. By using Ripple, you grant us:

  • License to store and process your data to provide the Service
  • Right to use anonymized, aggregated data for Service improvement
  • Authority to backup and secure your data
  • Permission to display your content within the app interface

5.3 Feedback and Suggestions

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or attribution.

6. Privacy and Data Protection

6.1 Privacy Policy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6.2 Data Security

Ripple is a productivity and goal-tracking tool, NOT a medical device or health application. We do not provide:

  • Medical advice or health recommendations
  • Treatment for any medical conditions
  • Professional counseling or therapy services
  • Guarantees about habit formation success

8.3 Third-Party Services

We are not responsible for:

  • Apple App Store policies or functionality
  • Device manufacturer limitations or issues
  • Internet connectivity or network problems
  • Third-party integrations or services

9. Limitation of Liability

9.1 Damages Limitation

To the maximum extent permitted by law, we shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, data, or business opportunities
  • Damages exceeding the amount paid for the Service in the past 12 months
  • Damages resulting from unauthorized access to your account

9.2 User Responsibility

You acknowledge responsibility for:

  • Backing up important personal data
  • Using the Service in accordance with these Terms
  • Protecting your account credentials and device security
  • Complying with applicable laws and regulations

10. Indemnification

You agree to indemnify, defend, and hold harmless Ripple, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Infringement of third-party rights
  • Your user-generated content or data
  • Unauthorized use of your account

11. Dispute Resolution

14. Apple App Store Specific Terms

14.1 App Store Compliance

This app is distributed through the Apple App Store and is subject to Apple's Licensed Application End User License Agreement (EULA) in addition to these Terms.

14.2 Payment Processing

All subscription payments are processed by Apple. We do not store payment information or have access to your payment details.

14.3 Refund Policy

Refunds for subscriptions are handled exclusively by Apple according to their refund policy. Contact Apple directly for refund requests.

14.4 Device Requirements

This app requires:

  • iOS 12.0 or later
  • Compatible iPhone, iPad, or iPod touch
  • Internet connection for full functionality
  • Sufficient storage space for app data

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and Ripple regarding your use of the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
